This Privacy Policy (the "Policy") explains how HaulFirst LLC ("HaulFirst," "we," "our," and "us") collects, uses, and discloses personal information through its website (the "Website"), its waste load management web platform (the "Platform"), and mobile application (the "App", and collectively with the Website and the Platform, the "Services").
Any capitalized terms that are not defined in this Policy are defined in our Terms of Service.
As explained further in this section, you will have the opportunity to provide us with certain personal information. In addition, we may collect certain personal information automatically through your use of the Services.
We will use this information to provide you with the functionality of our Services, to improve our Services, and to provide you with information about our Services. The rest of this section provides a more detailed explanation of the personal information we collect and how we use that personal information.
In order to create your Account on the Services, you will need to provide your name, email address, phone number, and physical address. You will also be required to choose a password. We collect this information from all Users, including Haulers (including Fleet Owners and Fleet Drivers), Brokers, and Centers to provide you with the functionality of our Services, including, without limitation, to create and manage Accounts, facilitate Loads, and communicate with Users.
Certain Users, including Fleet Owners, Fleet Drivers, Solo Haulers, and Brokers, may be required to upload compliance documentation, such as certificates of liability insurance, driver photographs, and driver's license photographs. We collect this information to verify required documentation and, where applicable, to display proof of compliance to Centers through the Services. This information is retained while your Account is active and may be retained thereafter as necessary for compliance, recordkeeping, dispute resolution, or legal purposes.
We may communicate with you if you have provided us the means to do so. For example, if you have given us your email address, we may send you promotional email offers or email you about your account and your use of the Services.
If you are interested in learning more about our Services, you may subscribe to promotional emails from us via our Website. In order to subscribe, you will be asked to provide your name and email address. If you are not otherwise a user of our Services, we will only use your personal information to send marketing communications relating to products and services that we offer.
Financial information necessary to process payments (such as bank account details or other payout information) is collected and processed directly by Stripe, our third-party payment processor. We do not store financial account numbers on our systems. We use Stripe Payments to charge Centers and Stripe Connect to facilitate payouts to Haulers and Brokers. Your use of payment functionality is subject to Stripe's terms and privacy practices. We retain transaction records and related payment metadata for accounting, compliance, and operational purposes.
For Haulers (including Fleet Drivers), the Services may collect real-time GPS location information while the App is in use. This information is used to enable certain functionality, such as determining eligibility to claim Loads, sending location-based notifications, and allowing users to mark Loads as picked up or delivered. GPS location data is used during active App sessions and is not stored by us beyond what is necessary to provide real-time functionality.
Whenever you interact with the Services, we automatically receive and record certain information from your browser or device, which may include your IP address, device identification, browser type, operating system, pages or features viewed, time spent on the Services, and general usage activity. We use first-party cookies to support core functionality of the Services, including maintaining authenticated sessions and keeping Users signed in. These cookies may remain on your device after your session ends. We may also use third-party tools such as Google Analytics, Google Tag Manager, and Firebase (including Firebase Analytics or related Google services) to understand how Users interact with the Services and to improve functionality and performance. These tools may use cookies or similar technologies to collect usage information. We may also use additional monitoring or performance tools (such as real user monitoring tools) to help us detect technical issues and improve system reliability. We may use web bugs or similar tracking technologies to help measure usage patterns and improve the Services. You may be able to adjust your browser settings to limit certain cookies; however, doing so may affect the functionality of the Services.
We may receive a confirmation when you open an email from us.
We may disclose your personal information to the categories of third parties identified in this section.
We employ personnel and engage other companies and people to perform tasks on our behalf and need to share your personal information with them to provide products or services to you. For example, as mentioned above we use a third-party payment processor to process payments on our behalf.
Please note that if you submit any personal information to a portion of the Services that is directed to, or accessible by, other Users, those Users will be able to see that personal information. Accordingly, only include personal information in such submissions that you are comfortable sharing with other Users.
If you use third-party applications (the "Third Party Apps") within the Services, Company will allow the providers of those Third Party Apps (the "Third Party Providers") to access or use your personal information as required for the interoperation of the Third Party Apps and the Services. Any Third Party Provider's use of your personal information is subject to the applicable agreement between you (or your organization) and the Third Party Provider. We are not responsible for any access to or use of your personal information by Third Party Providers. You and your organization are solely responsible for the decision to permit any Third Party Provider to use your personal information.
As mentioned above, we use Google Analytics and Google Tag Manager to understand how Users and visitors engage with our Services. You can learn more about the information that Google has access to at: https://policies.google.com/technologies/partner-sites.
We may de-identify your personal information so that you are not identified as an individual, and share that information with third parties. We may also provide aggregate usage information to third parties (or allow these third parties to collect aggregate information of activity on our Services), who may use that information to understand how often and in what ways people use our Services, so that they, too, can provide our users with an optimal online experience.
If we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, personal information could be one of the assets transferred to or acquired by a third party.
We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with governmental requests, law enforcement or court orders, or enforce or apply our Terms of Service and other agreements.
We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. In addition, we enter into contracts with all of our third-party service providers that require reasonable precautions be taken against unauthorized uses of your personal information.
We cannot, however, ensure or warrant that these precautions will always be successful or that your personal information on the Services may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
Through your account settings, you may access, edit, and delete your profile information. Please understand, however, that it may be impossible to delete this information completely, due to backups and records of deletions. In addition, we may deny a deletion request if (i) the denial is necessary for us to comply with applicable law, or (ii) the request pertains to content that you posted on a publicly available portion of the Services and that cannot be deleted without impacting the Services experience for other users. You may not request the removal of de-identified, anonymous, or aggregate data from our databases.

Subject to your right to request deletion of your personal information, we will retain your personal information as described herein, and if not explicitly stated, as long as needed for your use of the Services, your approved receipt of marketing communications from us, our compliance with legal obligations, and to protect our or others' interests.
We will honor your exercise of your rights with respect to your personal information in accordance with Section 5. Apart from those rights, we do not respond to Do Not Track signals.
Anyone under the age of 18 is not permitted to use, access, or register for the Services in any way. We do not knowingly collect or solicit information from anyone under the age of 13. If we learn that we have collected personal information from a child under the age of 13, we will delete that information as quickly as possible.
We are constantly trying to improve the Services, so we may need to change this Policy from time to time as well. The date of the last modification will be posted at the beginning of this Policy. It is your responsibility to check from time to time for updates. By continuing to access or use the Services, you are indicating that you agree to be bound by the modified Policy.
